TERMS & CONDITIONS

1. Payment Terms

  • Payment must be made within 14 days of the invoice date (Net 14).

  • Late payments may incur interest charges of 20% per month.
     

2. Reservation of Title and Risk

All Products remain the property of Technify until full payment is received. Risk transfers to the Customer upon shipment.
 

3. Delivery

Technify aims to deliver orders promptly, generally within 1-2 working days of receiving them. Special delivery arrangements can be made for urgent orders.
 

4. Failure to Collect Delivery

If the delivery is not collected and is returned to Technify, the Customer will be charged an administrative fee of 1000 NOK (excl. VAT) plus freight costs.
 

5. Freight Damages

Damages, even if not visible, must be reported to the carrier within seven (7) days of receipt.
 

6. Delay and Cancellation

Orders can be canceled if substantially delayed and not yet shipped.
 

7. Annulment

Orders can be annulled under applicable consumer protection laws. For Private Customers, this includes a standard right of withdrawal period as defined by local legislation. Products must be returned in their original condition and packaging. The Customer is responsible for return shipping costs.
 

8. The Product

Products are either used, new open box, or brand new. Brand new products are sold "as is" with limited functionality control. The Products are purchased from businesses and/or individuals who have acquired redundant spare parts from disposed machines. Products must be professionally installed and used according to manufacturer guidelines.
 

8.1 Product Categories

  • Brand New: Product factory sealed.

  • New Open Box: The Product may have been connected, but never commissioned. The Product may be in sealed original packaging, opened original packaging, or in different packaging.

  • Used: A previously used device, in good working condition for the particular product.

  • *Used - ... : A previously used device, in good working condition for the particular product, with cosmetic defects without relevance to the functionality of the Product.
     

8.2 Customer Responsibilities and Risks

The Customer assumes all risks during installation and use, including business interruption, equipment loss, data loss, and other damages. No guarantees are provided for normal wear and tear, incorrect installation, or misuse. Technify makes efforts to identify and exclude counterfeit parts but cannot fully guarantee against them. The Customer acquires and uses the Products at their own risk. Products must be installed according to the manufacturer’s recommendations. Technify is not liable for damages due to incorrect, non-professional, or negligent handling.
 

9. Limited Warranty

The warranty on the equipment is limited to the warranty provided by ABB. Technify does not take an intermediary role.
 

10. Limitation of Liability

Technify's liability is limited to cancellation, rectification, and termination as specified. Technify is not liable for direct or indirect damages, including loss of income or data.
 

11. Force Majeure

Technify is not liable for non-fulfillment due to circumstances beyond its control, such as war, natural disasters, or labor conflicts. Notification to the Customer will be made within a reasonable time.
 

12. Data Processing

Technify processes personal data in accordance with GDPR for delivering products and complying with legal obligations.
 

13. Dispute Resolution

Any disputes arising out of or in connection with this agreement shall be resolved through arbitration, or through the Norwegian courts if arbitration is not specified.
